[42 N.Y.2d 1053 Page 1053] Appeal from an order of the Appellate Division of the Supreme Court in the Second Judicial Department, entered May 10, 1976, which (1) reversed, on the law, a judgment of the Supreme Court at Special Term (Edwin R. Lynde, J.), entered in Nassau County in a proceeding pursuant to CPLR article 78, annulling a determination of the State Rent Administrator that the new legal regulated rent under a tenant's two-year renewal lease could not exceed $425.50 per month, and substituting a determination that the new legal regulated rent for the term of the renewal lease was $439.52 per month, (2) confirmed the administrator's determination, and (3) dismissed the petition to annul it. No findings of fact were presented for review. The tenant's base rent was $370 per month, and her legal regulated rent, which included $14.02 in additional rent called for by a tax escalator clause in her lease, was $384.02.
